1. Agreement to these terms
These Terms & Conditions form an agreement between you and Wanderfly Travel Private Limited ("Wanderfly", "we", "us"), registered at Vaddipalem, Narayana Medical College, 6/4/355, Nellore, Andhra Pradesh 524004, CIN U63030AP2022PTC122473. By accessing our website, applications or services (the "Services") you agree to them. If you do not agree, please do not use the Services.
They apply to two kinds of user:
- Customers — organisations that subscribe to Wanderfly for their people. Where a Customer has signed a separate order form or master agreement with us, that agreement prevails over these terms to the extent of any conflict.
- End Users — individuals who use the Services, whether enrolled by an employer or signed up directly.
2. Eligibility
You must be at least 18 years old and capable of entering a binding contract under the Indian Contract Act, 1872. If you use the Services on behalf of an organisation, you confirm you are authorised to bind that organisation to these terms.
3. Wanderfly is not a medical service
Wanderfly provides wellbeing information, tools and content for general educational purposes only.
It is not medical advice, diagnosis or treatment; it is not a medical device; and it does not create a doctor-patient, therapist-client or any other clinical relationship between you and Wanderfly. Always seek the advice of a qualified health professional with any question about a medical or mental health condition. Never disregard professional advice, or delay seeking it, because of something you read or received through the Services.
Wellbeing scores, recommendations and content are generated from the information you provide and from general models. They are not a clinical assessment, they may not reflect your circumstances, and you should not rely on them to make health decisions.
4. Emergencies
The Services are not an emergency or crisis service and are not monitored in real time. If you or someone else may be at risk of harm, contact emergency services or a crisis helpline immediately.

Do not use the Services to communicate an emergency. We cannot guarantee that anyone will read what you submit, or that we will read it in time to act.
5. Accounts and employer-provided access
You are responsible for keeping your credentials confidential and for activity under your account. Tell us promptly if you suspect unauthorised use. Where your employer provides your access, your account depends on their subscription: if it ends or they remove your access, your account may be suspended or deleted in line with our Privacy Policy.
6. Acceptable use
You agree not to:
- use the Services unlawfully, or to harass, abuse, defame or harm anyone;
- upload malicious code, or attempt to gain unauthorised access to the Services or another user's account;
- scrape, reverse-engineer, resell or create derivative works from the Services except as permitted by law;
- misrepresent your identity, or submit another person's personal or health information without their consent;
- interfere with the integrity or performance of the Services, or use them to build a competing product.
We may suspend or terminate access for breach of this section, with notice where practicable.
7. Fees
Fees, billing frequency and subscription term for Customers are set out in the applicable order form. Fees are exclusive of GST and other taxes, which are payable in addition. Unless stated otherwise in your order form or required by law, fees already paid are non-refundable. We may revise pricing on renewal with prior notice.
8. Third-party services and practitioners
The Services may link to third-party content, or facilitate access to independent counsellors, coaches, practitioners or wellness providers. Those parties are not our employees or agents. They are responsible for their own advice, conduct, qualifications and licensing, and your engagement with them is a matter between you and them. We do not endorse, and are not liable for, third-party content or services.
9. Intellectual property
The Services, including all software, content, design, trade marks and branding, are owned by Wanderfly or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for their intended purpose. All rights not expressly granted are reserved.
10. Your content and feedback
You keep ownership of the content you submit. You grant us a licence to host, store, process and display it strictly as needed to provide the Services and as described in our Privacy Policy. If you send us feedback or suggestions, we may use them without obligation or compensation to you.
11. Privacy
Our Privacy Policy explains how we handle personal data, including the limits on what an employer can see. It forms part of these terms.
12. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that they will produce any particular wellbeing, health or business outcome.
13. Limitation of liability
To the maximum extent permitted by law, Wanderfly will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for loss of profits, revenue, goodwill, data or anticipated savings, arising out of or relating to the Services, even if advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these terms or the Services will not exceed the amount you or your organisation paid us for the Services in the twelve months immediately preceding the event giving rise to the claim, or INR 5,000 where no fees were paid.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
14. Indemnity
You agree to indemnify and hold Wanderfly harmless against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the Services, or your violation of any law or third-party right.
15. Term and termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these terms, if required by law, or if your organisation's subscription ends. Sections that by their nature should survive termination — including sections 9, 12, 13, 14 and 16 — will do so.
16. Governing law and disputes
These terms are governed by the laws of India. The courts at Nellore will have exclusive jurisdiction, subject to any arbitration provision agreed in a Customer order form. Before starting formal proceedings, please contact us so we can try to resolve the matter directly.
17. Changes to these terms
We may update these terms from time to time. We will revise the "last updated" date above and, for material changes, give reasonable notice through the Services or by email. Continuing to use the Services after changes take effect means you accept them.
